A disclosure policy for social media training, from relationship register to correction
Build a social media training disclosure policy for England with relationship records, accessible labels, claim evidence and correction controls.
A social media training disclosure policy should tell a publisher when a course-related post is advertising, which relationship must be revealed, how the label appears in the actual format and who corrects a failure. It must also keep claim evidence, personal-data permission and intellectual-property rights on separate tracks.
What to take away
- A disclosure policy must state when a course post is advertising and who corrects a failure.
- Record the brand, creator, payment and editorial control before content is briefed.
- An Ad label must stay visible in the rendered format, including after cropping and with sound off.
- An Ad marker does not prove claims about outcomes, accreditation, employment, price or availability.
- Privacy, employment and intellectual-property decisions need separate review from disclosure.
Keep a relationship register
Before content is briefed, record the brand and legal entity, creator, employer or agency, payment, gift, free place, affiliate return, ownership, staff role, editorial control, platform and intended audience. Add start and end dates, approver and evidence location. The decision concerns the specific communication; a creator may publish independent material and advertising at different times.
Identification duties sit in section 2 of the CAP Code — the UK Code of Non-broadcast Advertising and Direct & Promotional Marketing, a self-regulatory code administered by the Advertising Standards Authority and not an Act — which calls for an ad to be recognisable as marketing.
The ASA/CAP Influencer's guide to making clear that ads are ads explains that paid or incentivised influencer content generally needs a prominent "Ad" label at the beginning of the caption, not buried in a hashtag list or left to a profile bio. Platform labelling may not suffice on its own, and this guidance is not legal advice.
Set rules for the rendered format
The policy should specify position, timing, visibility and persistence for a feed post, short video, livestream, audio, carousel and repost. View the content logged out, on mobile, with sound off and after the platform crops it. Preserve a screenshot or recording of what a user saw, not just the creator's publishing controls.
Do not hide the relationship after a click, among hashtags or only in a profile. A label must remain understandable when captions or transcripts carry the content, and any accessible alternative should meet Web Content Accessibility Guidelines (WCAG) 2.2. If an accessible alternative loses the disclosure or a qualification, withdraw the post until the corrected version passes review.
Protect the claim behind the label
An "Ad" marker does not prove a statement about course outcomes, accreditation, employment, price or availability. CAP Code section 3 requires evidence for capable objective claims before publication. The claim register should hold the exact wording, source, population, geography, period, limitations, owner and expiry.
Testimonials need their own provenance and permissions. Record who gave the statement, what experience it covers, whether it was edited and whether any incentive exists. The CMA's Hidden ads: being clear with your audience guidance sets out how UK consumer law applies to undisclosed advertising under the DMCC Act 2024, including statutory concerns that cannot be cleared by CAP review alone.
Separate privacy, employment and IP decisions
Agreement to attend or be filmed is not a complete basis for promotional reuse. A named privacy reviewer must document purpose, lawful basis, notice, retention, withdrawal consequences and any PECR issue for later contact. The ICO's lawful-basis guide sets out how to choose and record that basis under the UK GDPR, and should be re-checked because the Data (Use and Access) Act has changed parts of the framework.
Employees and learners may face unequal bargaining power, so obtain employment and education review rather than relying on a media release alone. Copyright in footage, slides, music and posts needs a separate licence or other valid permission. Disclosure of payment does not grant data or intellectual-property rights.
Monitor, correct and retire
Give one owner authority to pause distribution when the relationship changes, a label disappears, claim evidence expires, the post is reused in another format or a sector rule is triggered. Name the correction routes in advance: a complaint to the ASA, which investigates and publishes its rulings on its website; a report to the platform, which applies its own advertising policy and can remove or restrict the post; and, for consumer-law breaches, referral to the CMA under the DMCC Act 2024. The policy should name the decision-maker for each route and record the date a problem was found and the date it was corrected.
Keep the original, approval, live capture, complaint, correction, withdrawal and notification record in one correction log, on a template holding the date identified, who reported it, what was wrong, the action taken, the date corrected, the date notified, the approver and the retention period set by the policy. Define how reposts and paid amplification will be found and handled.
Financial promotions are regulated by the Financial Conduct Authority, and other controlled products need their own additional sector decision; ordinary disclosure wording is not enough. This policy stays on editorial hold until named UK advertising and consumer, privacy and PECR, accessibility, employment, IP and regulated-sector reviewers approve the actual workflow.
Before you act
- Record the relationship before briefing any content.
- Paste the approved "Ad" wording and placement into the brief.
- Check the label logged out, on mobile, with sound off.
- Hold evidence for objective claims before publication.
- Get separate privacy, employment and IP approval.
- Name one owner who can pause distribution.
- Name the decision-maker for each correction route.
- Keep the live capture and the correction log, and agree the review cadence.
Common questions
When does a social media post about a training course need an Ad label?
The ASA/CAP Influencer's guide to making clear that ads are ads says paid or incentivised influencer content will generally need a prominent Ad label at the beginning of the caption. Platform labelling may be insufficient on its own. CAP Code section 2 calls for an ad to be recognisable as marketing.
What should a claim register hold for course outcome statements?
CAP Code section 3 requires evidence for capable objective claims before publication. The claim register should hold the exact wording, source, population, geography, period, limitations, owner and expiry. An Ad marker does not prove a statement about outcomes, accreditation, employment, price or availability.
Can agreement to be filmed cover later promotional reuse?
No. Agreement to attend or be filmed is not a complete basis for promotional reuse. A named privacy reviewer must document purpose, lawful basis, notice, retention, withdrawal consequences and any PECR issue. Copyright in footage, slides, music and posts needs a separate licence or other valid permission.
